None of the children were married at the time, and the ages fit. There were no other children born before 1810 and three born after 1810. The list I saw was not done in order of dwellings so I do not know who was living next to them at this time (it was alphabetical). My incliniation is that there is a strong possibility that this is our Daniel. (This came from the original 1810 Census)

Dainiel Kessler died in 1840. He left no personal estate. He owned 200 acre tract that was conveyed to him by John Sandidge and his, Daniels widow, Eve got 66 2/3 acres as dower. Eve recently died and the 66 2/3 acres belongs to the estate of Daniel Kessler All the rest of his land was sold to pay his debts.

Green Co., Ky Circuit Case #100 1/2 1841 Thomas W. Lisle vs. Daniel Kessler Heirs
Thomas W. Lisle states that on 19 November, 1838, Daniel Kessler, being indebted to the~ for $73.64 gave him a note and mortgage on 200 acres of land in Green County and only $7.50 has been paid on the note. The rest is due.
Sometime since the note was made, Daniel Kessler departed this life intestate in Green County and no administration has been taken out on his estate. Daniel left a widow, Phebe Kessler, and the following persons his children:
1. Sarah Kessler married James Miller
2. Mary Judd married Nathaniel Judd
3. Anne Short married George Short
4. Elizabeth Hind married Thomas Hind
5. Henry Kessler
6. Soloman Kessler
7. Josiah Kessler
8. Benjamin Kessler
The land descended to the children. Lisle wants the land sold to pay the debt.
Answer of Eve Kessler:
She admits the debt and consents to a decree rendered in favor of Lisle for the debt as prayed for in the bill except the 1/3 part which she is claiming as her dowry in the land.
Answer of James Miller and wife, Sarah, George Short and wife, Ann, Nathaniel Judd and wife, Mary and Solomon, Josiah, Benjamin and Henry Kesler agreed to the decree to appoint Jordan Owens, Hugh Mitchell and Pleasant Sandidge Commissioners to allot to Eve Kessler, widow of Daniel Kessler her dower in the land.
Summonses to Green County: Phebe Kessler, widow of D. Kessler, deceased, Sarah Miller, James Miller, Mary Judd and Nathaniel Judd, Ann Short and George Short, Elizabeth Hind, Thomas Hind, Henry Kessler, Solomon Kessler, Josiah Kessler, Benjamin Kessler.

They admit the execution of the note and mortgage mentioned and that the debt remains unpaid except $7.50 and they consent 0 a decree rendered in Green County Circuit Court.

Whereas, I stand indebted to Thomas W. Lisle in the sum of $73.64 by note dated this day and payable in 12 months after date and being desirous of securing Lisle in the payment of said note, I lave this day sold to Lisle a tract in Green County on Tramel's Creek containing 200 acres and is the same land that was deeded to me by Jon Sandidge and recorded in Green County, bounded as follows: Beg. at a dogwood and two poplar trees northwest comer of W. Sutton's survey..to a sassafras spanish oak and dogwood., thence N.55W 141 poles to a white oak thence N.35E 180 poles ~ with two back oaks & dogwood...S55E 200 poles on Ben Holland line and passing his corner to a poplar red oak and dogwood on J. B. Holland line and with it S23W 93 poles to a double white oak n Sutton's line...N.65W90 poles to beg. If I pay off a note of $73.64 when if falls due then this conveyance be void. Whereas I bought the land named in this mortgage the money had been paid me by Mr. Kessler and I hereby release all claim. Nov. 19, 1838 Christopher Goalder
It appears to the satisfaction of the court that the defendant has failed to pay the debt and the dower has been allotted to the widow of Daniel Kessler in the land. Therefore, it is now decreed that William B. Carlile be appointed a Commissioner to sell at the courthouse door in Greensburg.
Survey:
Agreeable to the order of Green County Circuit Court, November term, 1841, We the undersigned Commissioners met on the lands of Dan' I Kestler, deceased, on this the 9th day of May, 1842 for the purpose of laying off the dower of Mrs. Kestler the relict of Daniel Kestler out of the 200 acre survey as appears by reference to a cop; of a deed filed in the case after being first duly sworn to perform our duty. We began at a white oak the 3rd corner from the beginning called for in said deed (on the plat herewith exhibited at No.3, thence reversing the call S55E 20 poles to two beechs and maple on the old line marked by us (letter A) thence a new line made by us N.65.E 90 poles to a pursimmon tree (at B) thence through the farm N.42.E 106 poles to white oak and pursirnrnon trees on the old line (at C) thence with said old line north 55 west 76 poles to two black oats to a dogwood (at No.4) thence with another of the old lines reversing the same S.35.W 180 poles to the beginning and containing 662/3 acres being one third in quantity and in our judgment one third in value.

The land sold on 18 July, 1842 at the courthouse door. Thomas W. Lisle was the highest bidder for $88.50 which is the amount of the decree and costs.

Green Co., KY Circuit Case #3724 October 1836 Christopher Golder vs. Daniel Kessler
Christopher Golder states that Daniel Kessler owes him a note of $30.68 dated 28 April 1834 due in three months. Kessler gave a mortgage on a tract of land in Green County on Trammell's Creek of 200 acres bounded by John Sandidge and recorded in Green County. The note is unpaid. He wants a sale of the land to pay the debt.
Mortgage:
Whereas I stand justly indebted to Christopher Golder in the sum of $30.68 by note dated this day and due three months after date and said Golder stands bound as my security in a note to Thomas W. Lisle for $62.00 on the 16 December last and being desirous of securing the payment of the note to Golder and of securing him as my security in the note to Lisle, I have this day sold to C. Golder and his heirs a certain tract or parcel of land lying in Green County on Trammel's Creek containing 200 acres. It is bounded as set forth in a deed from John Sandidge to me now of record in the Green County Clerk's Office. If I pay off the note to Golder and hold him harmless as my security in the note to Lisle; then this mortgage to be void. This 28 April; 1834.

Kessler failed to answer and it is taken as confessed. The mortgage is foreclosed and Kessler is to pay the debt before the next term of court.
Decree: Joshua V. M. Shreve appointed commissioner to sell the land at the door of the courthouse in Greensburg.
11 November 1837:
Daniel Kessler and Christopher Goalder both by mutual agreement selected William Hutcheson and James McDaniel (housekeeper and citizens of Green County) to value the land and in the decree directed to be held to said Hutcheson, McDaniel being first duly sworn do value the land at $1.50 per acre amounting to $300 for said 200 acres.

By virtue of and in conformity with the within decree of the Green County Circuit Court at the August term 1837 in favor of Christopher Goalder vs. Daniel Kesler, I, Joshua M. V. Shreve, Commisioner, after having had the land in the decree mentioned duly valued which is $1.50 per acre making $300 the value of the 200 acres and having advertised the same as the land directs did offer the land at public auction to the highest bidder at the courthouse door in Greensburg on 11 Nov 1837 and Christopher Gaolder being the highest bidder became the purchaser of the sum of $46.18 and 1/2 which sum satisfies the decree and no more.
